Agreement to Official Promotion Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCE OF WINNING. FEDERAL, STATE AND LOCAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED BY ALL U.S. FEDERAL, STATE, LOCAL LAWS, CODES AND OTHER SIMILAR GOVERNING LAWS, RULES, REGULATIONS AND/OR ORDINANCES.

By participating, Entrants agree to abide by and be bound by these Official Promotion Rules ("Rules") and the Terms and Conditions ("Terms") set forth below, which are final and binding in all matters relating to the Promotion. Winning a prize is contingent upon fulfilling all requirements set forth herein. Sponsor reserves the right to interpret and apply these Rules and Terms in its sole discretion, and to modify or terminate the Promotion at any time.

TERMS AND CONDITIONS

Eligibility
The Alaska Mountain Guides Sweepstakes is open only to those who sign up at the online page (or other entry method) and who are eligible as of the date of entry. It is open only to legal residents of the fifty (50) United States and the District of Columbia who are 18 years of age or older at the time of entry. Employees, directors, suppliers, agencies performing advertising, promotional, fulfillment and marketing, their immediate families and those living in the same household of each are not eligible to participate in any Sweepstakes. THE PROMOTION IS VOID OUTSIDE OF THE UNITED STATES, AND WHERE PROHIBITED BY LAW.

Agreement
By participating in the sweepstakes, you agree to the applicable official rules, you meet the eligibility requirements and you agree to accept the decisions of Alaska Mountain Guides, whose decisions are final and binding in all respects. By participating in any sweepstakes as an entrant, (“entrant” or “you”) you also agree to be fully and unconditionally bound by the applicable official rules. You will waive any right to claim ambiguity in these sweepstakes and/or the applicable official rules and further agree to be bound by Alaska Mountain Guides’ decisions and interpretation of any official rules.

All data requested at registration, prize fulfillment or at any other time in connection with any sweepstakes must be accurate. If inaccurate information is supplied, it will result in your disqualification from the applicable sweepstakes and prevent the awarding of any prize that you may have won.

How to enter
Promotion Period: The Promotion Period starts (date) at (time) Alaska Standard Time (AKST) and ends at (date) at (time) AKST ("Promotion Period"). Sponsor controls the official time-keeping device for the Promotion. Any Sweepstakes must be entered by submitting an entry using the online form provided. The entry must fulfill Sweepstakes requirements, as specified, to be eligible to win a prize. Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Alaska Mountain Guides. You may enter only once, and you must fill in the information requested. You may not enter more times than indicated by using multiple email addresses, identities or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules, your submission may be removed from eligibility at the sole discretion of Alaska Mountain Guides.

Prizes
One winner will be randomly selected to win two excursion tickets not exceeding the $230 price of each ticket. The prize is non refundable and non transferable.Price must be used before September 2022. Winners will not receive compensation for any prize elements that the winner is unable to use for any reason. The specifics of the prize shall be solely determined by Alaska Mountain Guides. No cash or other prize substitution will be permitted. Any and all prize related expenses, including, without limitation, any and all federal, state and/or local taxes shall be the sole responsibility of the winner. No substitution of prizes or transfer/assignment of prizes to others or requested may be made for the cash equivalent. Winners agree to accept prize "as is." Alaska Mountain Guides may request a winner’s name, likeness and entry for purposes of advertising and trade without further compensation, unless prohibited by law.

Prizes will be provided in accordance with these Official Rules. An Entrant is not a winner of any prize unless and until Entrant’s eligibility and the potential Sweepstakes winner have been verified and Entrant has been notified that verification is complete. Potential winners must comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements.

Notification
The Prize winner will be randomly selected. Winners will be notified via email to the email address they entered the Sweepstakes with following the winner selection. Alaska Mountain Guides shall have no liability for a winner’s failure to receive notices due to winners’ spam, junk e-mail or other security settings or for winners’ provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within Fifteen (15) days from the time award notification was sent, or fails to timely return a completed and executed declaration and releases as required the prize may be forfeited and an alternate winner selected. All decisions are final and binding in all matters related to this Sweepstakes.

No prize transfer, assignment or substitution by Winner permitted.

Other terms and conditions
Each Winner acknowledges and agrees that the Winner's name and photo may be published by Sponsor and its designees, licensees or affiliates, which will not be required to pay any additional consideration or seek any additional approval from Winner in connection with such use.

Certain restrictions may apply.

Sponsor reserves the right, at its sole discretion, to disqualify any individual deemed to be (a) tampering or attempting to tamper with the methods of entry; or (b) acting in violation of these Rules or in an unsportsmanlike or disruptive manner. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

RELEASE AND LIMITATIONS OF LIABILITY. By participating in the Sweepstakes, Entrants agree to release and hold harmless the Sponsor, its respective officers, directors, employees, agents, subsidiaries, affiliates, distributors, sales representatives, advertising and promotional agencies from any causes of action arising out of participation in the Promotion or receipt or use of any Prize, including, but not limited to: (a) any technical errors that may prevent an Entrant from submitting an entry; (b) unauthorized human intervention in the Promotion; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors, technical or otherwise, in the administration of the Promotion or the processing of entries; or (f) injury, death, or damages (including punitive, consequential, direct or indirect) to persons or property which may be caused, directly or indirectly, in whole or in Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries.

Notice to individuals, removal from mailing list. Any individual (or other duly authorized person) may elect to exclude the name and address of that individual from all lists used by Sponsor related to the Promotion. To elect to omit all such lists, submit a removal request in writing to: Alaska Mountain Guides P.O. Box 1081, Haines, AK 99827. This notification system may be used to prohibit mailing of all Promotions by Sponsor to such individual.

Dispute Resolution. Except where prohibited, you agree that any and all disputes, claims and causes of action arising out of, or connected with, the Promotion or any Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Alaska. All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, your rights and obligations, or the rights and obligations of Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with the laws of the State of Washington without giving effect to any choice of law or conflict of law rules (whether of the State of Washington or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Alaska.
